Thank you for contacting the Consular Section of the U.S. Embassy, Kathmandu in regard to the visa denials of you. We understand that a visa denial can be very difficult to accept by all concerned. However, once a visa decision has been made during an interview it cannot be reconsidered. Please understand that we are not allowed to discuss the specifics of individual visa cases with persons other than the applicant. As background, the Immigration and Nationality Act (INA) requires all applicants for visas to prove to the interviewing consular officer that they meet the eligibility criteria specified in the law. The burden of proof rests on the applicant. When evaluating whether applicants can overcome the presumption of immigrant intent, consular officers look for solid reasons a person would return to their own country. In doing this, they take into consideration the totality of an applicant’s situation, including family, community, professional, property, and economic ties to the applicant’s home country. Relationships with friends or relatives in the U.S. may also be considered to assess whether the applicant has stronger links to people in the U.S. than to those at home. Please understand that no person or organization can “sponsor” any foreign national for a tourist visa. Each applicant must overcome the presumption of immigrant intent based upon his/her own merit no matter how compelling the situation in the United States. Regrettably, they were unable to overcome that presumption during their interview. Under immigration law, the burden of proof rests with the applicant. Ineligibility under Section 214(b) is not permanent, however. They may wish to reapply when they are in a better position to establish their ties to Nepal and their entitlement to nonimmigrant status. Please be assured that they were interviewed by an experienced and professional consular officer and given every consideration consistent with U.S. immigration law and applicable regulations. Further information regarding visa denials may be found at the this web site: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/visa-denials.html. Sincerely, Consular Section U.S. Embassy Kathmandu, Nepal https://np.usembassy.gov/
